Sure lots of things have environmental impact, few are as pointless.

HAM? Extravagant Xmas displays are almost as environmentally harmful as they are tacky. I have seen some tasteful ones, but gotta be under 1%. That said, I realize lighting candles for 8 nights also produces some carbon.

If they offer it in Feb for next season, bye bye Blue. Dont need both passes for one season.

Started driving a 73 cop package LTD that got about 6mpg but the big old hunk of iron saved my life 2x as I was a classic male teen "driver" -
No, because they operating a business generating millions of annual revenue competing with other such businesses, and because most people would believe photos of a ski area on a ski area web page were shot at the ski area. It is more like if I had photoshopped a stock photo of Paul McCartney holding a bass onto my album cover.

We do sometimes play Beatles covers and 3.5 years ago played an all Beatles set, but I am not sure what sort of claim you are getting at. You think actual Beatles cover bands would claim they lost income because by posting a pic of ourselves in those shirts we were seeking to fool folks into believing that we were also a Beatles cover band? Also not sure what sort of claim anyone could have for thinking we were selling T Shirts we were not selling. But if anyone feels they have been damaged by my practices, we can enter settlement discussions and, if those fail to provide mutual satisfaction, work it out in court.

The damages in a false advertising case are suffered by competitors. Camelback would argue they lost X million skier visits because folks thought that is what Blue looked like.

No I did not use them in advertisements. If they were up at BeaglesBand.com, and if The Beatles had a good argument that we had unjustly profited by tricking folks into believing we were the Beatles and buying our CD when they meant to purchase Abbey Rd, you would have a point. Honestly though, if The Beatles were to sue me, I would gladly give them all the profits I made from wearing that shirt and would welcome the publicity.

If you dont want Blue to get sued the better move would be to let their marketing folks know they should pull down pix that constitute false advertising. My commenting on an existing thread is not what will get them sued.

If a venue hires a band to play cover songs, they get licenses from ASCAP, BMI and SESAC to cover that use. If a venue prefers not to get such licenses we are glad to perform all original material.

It is ridiculous and deceptive to use a photo from a different ski area on their site. It may well be legally actionable as well but blue may be too small potatoes for anyone to care enough to sue.

Upper Main St and x-ing taught the girls the term "cookies" - otherwise quite nice. No wait at all to board chairs yet. Enjoying our cocoa now. Gotta love day that starts with skiing and ends with a televised performance at www.cafeimprov.com (broadcast Mon eve).
