In reading the actual filing by Sno Mountain, here's the meat of the lawsuit: 28. In August 2006, Defendant Washo falsely, maliciously and defamatorily made statements to third persons, including but not limited The Scranton Times Tribune, the import of which was that Sno Mountain and Denis Carlson violated the law and/or engaged in criminal misconduct. Some of Defendant Washo's false and defamatory statements were then re- published to the public at large by The Scranton Times Tribune. For example, Defendant Washo referred to the Purchase Agreement between the Lackawanna County Board of Commissioners as being the product of "back room dealings" and that the Purchase Agreement "violates county and state law." These comments were printed by The Scranton Times Tribune on or about August 4, 2006. 29. The foregoing conduct by Defendant Washo is not shielded by the doctrine of official immunity because these actions, including but are not limited to: (1) filing a lawsuit in his individual capacity; (2) making false and defamatory claims regarding the nature and legality of the Purchase Agreement; and (3) making the foregoing false, malicious and defamatory statements regarding Sno Mountain and Denis Carlson to third parties and to the press, are all outside the scope of Defendant Washo's official duties as a County Commissioner. Moreover, these activities by Defendant Washo are malicious, intentionally wrongful, reckless, negligent or otherwise improper. 30. On information and belief, it is averred that Defendant Washo's aforesaid actions are motivated by political or partisan considerations rather than taken in furtherance of his duties and responsibilities to the citizens of Lackawanna County. 31. The aforesaid actions by Defendant Washo also directly interfere with constitutionally protected property rights of the Plaintiffs. Although Defendant Washo is privileged by virtue of his office to disagree with the majority Commissioners with respect to the wisdom of selling Montage Ski Area to Sno Mountain, he is not privileged to make frivolous, factually incorrect and otherwise non-meritorious allegations against his fellow Commissioners and Sno Mountain. Nor is Defendant Washo privileged to tortiously interfere with a lawful and binding contract between Lackawanna County and Sno Mountain. Nor is Defendant Washo privileged to publish false and defamatory statements regarding Sno Mountain and/or Denis Carlson. *(recap) 37. Plaintiffs Sno Mountain and Denis Carlson have suffered actual legal damage as a direct and proximate result of Defendant Washo's actions as alleged above. Such damages exceed the sum of $50,000 and are continuing in nature. 38. Plaintiffs are entitled to recover an award of punitive or exemplary damages as a result of Defendant Washo's outrageous conduct and for the purpose of punishing and deterring such conduct. WHEREFORE, plaintiff, Sno Mountain LLC, demands judgment in its favor and against defendant Michael J. Washo and request an award of compensatory damages in excess of the jurisdictional amount of Fifty Thousand Dollars ($50,000.00), plus interest and costs, and further requests an award of punitive damages, together with whatever other relief is deemed appropriate by the Court. *(recap) 41. As alleged above, Defendant Speicher has taken purposeful actions which were specifically intended to harm the existing contractual relationship between Lackawanna County and Sno Mountain. 42. Defendant Speicher is not privileged or justified in engaging in the aforesaid purposeful actions with respect to Sno Mountain. 43. Defendant Speicher's actions were willful and deliberate. Defendant Speicher's actions are obviously motivated by a desire to obtain Montage Ski Area for himself on terms less advantageous than those offered by Sno Mountain. 44. Plaintiffs Sno Mountain and Denis Carlson have suffered actual legal damage as a direct and proximate result of Defendant Speicher's actions as alleged above exceed the sum of $50,000 and are continuing in nature. 45. Plaintiffs are entitled to recover an award of punitive or exemplary damages as a result of defendant Speicher's outrageous conduct and to punish and deter such conduct. WHEREFORE, plaintiff, Sno Mountain LLC, demands judgment in its favor and against defendant Christopher J. Speicher and request an award of compensatory damages in excess of the jurisdictional amount of Fifty Thousand Dollars ($50,000.00), plus interest and costs, and further requests an award of punitive damages, together with whatever other relief is deemed appropriate by the Court.

Stupidest line: "Balderdash," cried Washo. Who the f*ck says balderdash? Thanks, Pyro, I had missed this story. You can call elected or appointed public officials names, but you can't just be calling private citizens "crooks" without facing repercussions. Oh, and according to a typical insurance policy that covers county commisioners, they are NOT automatically covered if they commit slander. The idea is that if a public official commits a crime, they are on their own. Washo says he isn't impressed? I bet the f*cker is looking back over every transcript to see what he really said. Who said they weren't businessmen? And no shit that they can do what they want in 10 years. Maybe they'll decide to rip apart a $20 to $40 million 4-season resort and sell it for $12 million in land. Yeah, that makes sense. It makes about as much sense as the second sentence of your post. And just for your info, Rob, SNLLC can sell it at any time, but they'll still have to have it appraised as a ski area because the 10 yr commitment transfers. Who cares?

After they tear down the $20 million water park, new lodges and lifts? Is that the plan, Rob? Once---in the entire history of real estate---has a company passed on buying nearby property for under one million for the privledge of spending over $20 million as part of a conspiracy? From the T-T yesterday: "He (Washo) pointed out that a 2002 sale of land contiguous to Montage netted $22,000 per acre for a 58-acre, undeveloped parcel." If you are selling a parcel of land, Rob, does it appraise for the parcel or the amount you'd get after subdividing? What's your guess, Rob? I'll give you a hint: THE ENTIRE PARCEL. If Lackawanna County wants to ditch skiing and develop the entire property as housing, then the appraisal should take that into consideration. But the property is being sold with the buyer being obligated to run it as a ski resort for an entire decade. And it's a ski resort with a history of losing a million dollars a year. Washo wants it appraised as if it's being sold for real estate development, yet the contract makes it impossible to do that for 10 years.

Despite the biased headline written by the very biased Times-Tribune editors, Montage's value during the recent appraisal was decided on the value of the property as a ski resort, rather than as property to be subdivided and sold off. And why? Because the new owners are obligated to run it as a ski resort. The appraisal takes into consideration what the actual use of the property will be. The little bitch Washo started jumping up and down, sweat leaping from his make-up caked face. He thought he had them right where he wanted. Washo has allowed a local developer to join in his lawsuit...hmmmm...no wonder why he wanted an appraisal for the land as property to be developed! The little bitch has his own "backroom" deal in the works! ************

Firstly, the Scranton Times-Tribune continued to show it's bias by running two letters to the editor, BOTH of which were anti-sale. This is typical of some newspapers that publish with an agenda, rather than what newspapers traditionally do, which is to provide a balanced view. Imagine if Allentown wanted to build a skate park and the local paper only printed anti-skate park letters, while pro-park letters went in the trash? The deal is set to close right now. If the injunction is denied, I suppose the pens will be ready. Sno Mountain can absolutely back out of the deal. But they've already made a huge investment and did their research. They knew what the ski area was worth. But SM LLC is investing this money to create a year-'round attraction. 90+ days should be plenty of time to get at least a good number of new guns installed. At this point, though, we'd probably all just take getting the new owners in place and be happy with whatever they can get done. The alternative is very bad.

Breaking News: Montage appraised at $4.3 million 6:10 p.m. By Roger DuPuis II / Staff Writer 08/17/2006 SCRANTON -- Montage Mountain Ski Area is worth $4.3 million, according to an appraisal made public by Lackawanna County majority Commissioner Robert C. Cordaro Thursday afternoon. The appraisal, prepared by New Hampshire-based ResortNorth Valuation for local appraiser Nasser Real Estate, was received by the county within the hour prior to its release at a 5 p.m. press conference, Mr. Cordaro said. The county is in the process of selling Montage to a Philadelphia group, Sno Mountain, LLC for $5.1 million. Mr. Cordaro also announced Thursday that Sno Mountain has made an offer to increase its guaranteed investment in the property from $14 million to about $20 million.
